1. About us and these terms
This website and the Logicraft brand are operated by Bigheart Products Ltd, a company registered in England and Wales (company number 16647944), registered office 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. These Terms & Conditions of Sale (the “Terms”) govern the sale of products through our website to you as a consumer. Please read them before placing an order. By placing an order you agree to these Terms. They do not affect your statutory rights.
2. Definitions
- “We”, “us”, “our” means Bigheart Products Ltd trading as Logicraft.
- “You” means the person placing an order through our website.
- “Products” means the goods we offer for sale on our website.
- “Order” means your order for Products.
- “Contract” means the contract between you and us for the sale of Products, formed as set out in clause 4.
3. Who can buy
To place an order you must be at least 18 years old, have a delivery address in the United Kingdom, and be buying as a consumer (not for business resale).
4. How the contract is formed
- Your order is an offer to buy the Products. After you place an order you will receive an acknowledgement email confirming we have received it — this is not acceptance of your order.
- A Contract is formed only when we send you a dispatch confirmation email confirming the Products have been dispatched.
- If we cannot accept your order (for example, the Product is out of stock, we identify a pricing or description error, or we are unable to authorise your payment) we will let you know and will not charge you, or will refund any payment taken.
5. Products
- We take care to describe and show our Products accurately. Images and packaging are for illustration; minor variations may occur.
- Our Products are intended for purchase by adults. Please follow any age guidance, warnings and instructions supplied with the Product.
6. Price and payment
- The price of the Products is the price shown on our website at the time you place your order. All prices include UK VAT.
- Delivery costs (if any) are shown separately at checkout before you pay. See our Shipping Policy.
- Payment is taken at checkout through Shopify Payments (powered by Stripe) and PayPal. We do not store your full card details.
- Despite our reasonable efforts, a Product may occasionally be mispriced. If the correct price is higher than the price shown, we will contact you before dispatch for your instructions, or reject the order and refund you. We are not obliged to supply at an incorrect price where the error is obvious and could reasonably have been recognised by you.
7. Delivery
- We deliver within the United Kingdom only. Delivery options, timescales and costs are set out in our Shipping Policy.
- Unless we agree otherwise, we will deliver without undue delay and within 30 days of the Contract. Delivery times are estimates and are not guaranteed.
- The Products become your responsibility (risk) when they are delivered to the address you gave us. You own the Products once we have received payment in full.
8. Your right to change your mind (cancellation)
As a consumer buying at a distance you have a legal right under the Consumer Contracts Regulations 2013 to cancel your order within 14 days of receiving the Products, without giving a reason. We extend this to 30 days as a goodwill gesture. Full details — including how to cancel, return timescales, who pays return postage, and how refunds work — are in our Returns & Refunds Policy, which forms part of these Terms.
9. Faulty or misdescribed Products
If a Product is faulty, damaged on arrival or not as described, you have rights under the Consumer Rights Act 2015, including (in summary) a 30-day right to reject for a full refund, and after that a right to repair, replacement or a refund. These rights are in addition to your right to change your mind. See our Returns & Refunds Policy.
10. Our liability to you
- We do not exclude or limit our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud, and for any of your statutory rights as a consumer.
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.
- We are not liable for business losses. We supply Products for domestic and private use; if you use them for any commercial purpose we have no liability for loss of profit, business, or business interruption.
- Subject to the above, our total liability arising from a Contract is limited to the price you paid for the Order. [Confirm cap.]
11. Events outside our control
We are not responsible for delays or failure to perform caused by events outside our reasonable control (for example, carrier failures, severe weather, or supply disruption). If such an event occurs we will contact you and take reasonable steps to minimise the delay; if the delay is substantial you may cancel the affected Order for a refund of Products not received.
12. Your personal data
We use your personal data in accordance with our Privacy Policy and Cookie Policy.
13. Complaints and dispute resolution
If something goes wrong, please contact us first at bigheartproductsltd@gmail.com — we aim to resolve complaints quickly and fairly. If we cannot resolve a dispute, you may be able to use an Alternative Dispute Resolution (ADR) scheme; contact us for details. Nothing in these Terms prevents you from bringing a claim in the courts.
14. General
- We may transfer our rights and obligations under a Contract to another organisation; this will not affect your rights.
- You may only transfer your rights or obligations to someone else if we agree in writing.
- If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in force.
- If we do not insist that you perform an obligation, or delay in enforcing our rights, that does not waive our rights.
- We may revise these Terms from time to time; the version that applies to your Order is the one published when you placed it.
- A person who is not a party to a Contract has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce it.
15. Governing law and jurisdiction
These Terms and any dispute arising from them are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts, as provided by law.
